AAU researchers contribute to new knowledge about the regulatory system for the protection and sustainable use of marine areas

Together with leading national and international research communities and actors, the research group Global and Transnational Law at the AAU Department of Law has acquired significant research competencies in relation to the United Nations Convention on the Law of the Sea (UNCLOS) and the general maritime regulatory system.

The research concerns both theoretical considerations in relation to UNCLOS as a regulatory system as well as specific issues in relation to legal regulations and effective enforcement. As an example, this is important in the legal framework for the protection of the marine environment.

Effective protection of the marine environment

‘Put simply, effective protection of the marine environment requires not only an appropriate legal framework on both national and international level, it also requires effective implementation of the legal framework and effective enforcement by states and other relevant actors. In addition, effective protection of the marine environment also requires well-functioning cooperation between states, national and international institutions and other relevant actors such as the shipping industry. We therefore not only include an analysis of the existing legal regulations, but also the question of how this framework works in reality and what possible legal or factual barriers could be used for the protection and sustainable use of marine areas’, says Professor (MSO) Birgit Feldtmann, Department of Law.   

UNCLOS and the general maritime law system are a key factor in achieving the UN Sustainable Development Goal no. 14. In addition, research into the regulatory system for the protection and sustainable use of marine areas contributes to the UN Sustainable Development Goal no. 16, where legal rights and, not least, the establishment of responsible and transparent institutions with participatory and representative decision-making processes are key content elements with target achievement indicators.
