Description

This module allows individual students to explore a self-chosen topic in private law in greater depth and prepare an academic paper in English. The topic chosen must be of an international and/or comparative legal nature and agreed upon by the course leader.

All topics within the realm of private law are welcome provided they are of an international and/or comparative nature. For example, a paper could focus:

•  on comparing the contract law consequences of the delivery of a faulty product in two or more jurisdictions;
• on the implications of a choice of court agreement in an insurance contract involving a consumer from one jurisdiction suffering harm in another;
• or the liability of a company who pollutes a river in one country, resulting in the death of a fish in a fish farm in another.

Writing a paper for this course not only would allow students to improve their English language writing skills and prepare them for the competitive national and international legal market, but it would also provide valuable practice for writing a master’s thesis. Students will be provided with a designated supervisor throughout the project period.

All topics within the realm of public international and human rights law are welcomed provided they are of an international and/or comparative nature. For example, a paper could focus on:

• the legal position of defendants accused of crimes against humanity in another state;
• the legal rights of refugees to apply for asylum
• or to work in different jurisdictions; comparing the national measures regarding cross-border pollution;
• analysing the integration of international arbitration in resolving investment disputes in different jurisdictions;
• or on a  states’ international legal responsibility for drone attacks or disturbance of the air space of other states.

Course module [5 ECTS]

Description

The module provides a fundamental understanding of key elements of legal method, company law, contracts for international sales of goods, EU law and international private law.

Through the module, the students gain basic legal skills in relation to the above-mentioned legal areas applied in a commercial economic context. In the module, the students will e.g. work with fundamental EU law, international buying and selling and company law.

Course module [5 ECTS]

Description

The aim of the module is to provide the student with a basic knowledge of the preparation of a problem formulation and an understanding of how to work with problem-based learning.

The focus is on project management and process competences, which include practical and theoretical tools to organise project work and the group process in a way that enhances both individual learning and the quality of problem-oriented group work.

The module also includes an introduction to the philosophy of science for business economists, which is related to problem- and project-based learning. This is similar to how the philosophy of science is related to knowledge elements from the other modules in the semester with a view to scientific theoretical reflection and application.

Finally, the module will introduce digital literature search and reference management.

Description

The course will introduce students to international human rights law as in intrinsic part of public international law, the concept of human rights from a legal point of view as well as the legal and institutional human rights framework of the United Nations with reference to the principal regional human rights systems.

The meaning and content of positive state obligations and limitations on substantive human rights (including the concept of “state discretion” or the “margin of appreciation” will be discussed, as will the role of human rights in specific contexts (such as the so-called “war on terror”).

Description

The legal profession and commercial activities are increasingly engaged in international activities. For this reason, legal graduates should possess the fundamental knowledge and skills required to operate within the international legal sphere.

In this course the focus is on the international rules and principles governing cross-border contracts concerning sale of goods. The basis for the course is the 1980 UN Sales Convention, but a number of other international sources of law will be introduced as well. The course relies on student participation for analysis of hypothetical and practical cases, contracting practice etc.

Description

The course focuses on family law issues in a comparative and international context and prior knowledge of family law or comparative law is not required.

Topics include:

• property and maintenance on divorce,
• the grounds for divorce,
• the legal status of cohabitants/de facto relationship,
• legal regulation of adult relationships and changing family constructs,
• marital agreements (i.e. pre-nuptial, post-nuptial and separation agreement),
• the status and relevance of gender in family law (including the legal status of transgender, non-binary and intersex persons);
• the legal relationship of parents and children (including multiparenting, surrogacy, adoption and parenthood and parental responsibility).

All topics are covered from a comparative perspective.

This course will be taught as an interactive course, and active student participation is expected. For all sessions mandatory and voluntary additional reading will be set. Participants are expected to have done the mandatory reading for each session in advance to be able to participate and discuss the material.

This course will be of interest to anyone wanting to acquire an up-to-date understanding of current policy and issues in family law around the world and anyone with an interest in family law, comparative law and social policy. It is also of interest to those who have no intention of pursuing a career in family law, as advising commercial and corporate clients properly requires the knowledge and ability to spot family law issues/risks and then seek specialist advice.

Description

The course will look at the sources of EU consumer law, the concept of ”consumer” and consumer organisations, EU Law’s interaction with Member State consumer Law and the purpose of consumer protection more broadly and its interaction with other regulation.

Selected consumer law issues include:

• sale of consumer goods (including lack of conformity,
• rights of the consumers in case of lack of conformity and the right of withdrawal),
• commercial practice (including unfair and misleading commercial practice,
• identification, unsolicited communication, commercial practices targeted specifically at children and young people,
• guarantees and price information),
• unfair contract terms,
• means of payment,
• passengers’ rights,
• complaints and sanctions.

Students will learn about the sharing economy and gain knowledge about the impact of digitalisation on consumer protection legislation.

Description

The course enable the students approaching for the first time the protection of the environment in international law and EU Law to dominate the essence of this crucial theme in continuous development. At the same time, the course offer the student the possibility to specialize in several areas or sectors of international environmental law.

The course is divided in two parts: the generel part I, and the specific and sectorial part II. 

The general part I treats the subjects:, 

• sources, general principles,
• the protection of the environment and human rights, 
• citizen’s right to information,
• public participation and access to justice, and
• environmental liability and responsibility as a consequence of environmental damage. 

The specific and sectorial part II will focus on:

• atmospheric pollution and climate change,
• the law of the sea and the protection of the marine environment,
• protection of the high seas from oil pollution and dumping of pollutants,
• protection of species and biological diversity, and
• transboundary movements of hazardous waste.

Special focus will be dedicated to the European Union (EU) focusing on EU-regulations, directives,  and the new objectives of the EU Green Deal and other EU hot topics such as the protection of biological diversity and international protected nature areas (Natura 2000-areas), resource management  (regulation of water, waste and renewable energy), marine spatial planning, ecosystem based management also within the context of the EU Blue Economy.

The course will be oriented in a problem-solving approach and will be split up into a series of workshops based on project’s works.

The exchange is open to all students enrolled in studies of law at recognised institutions. 

Students must have relevant academic skills. Applications from exchange students will be evaluated by an academic evaluator.
